1. Definitions

• You / Donor: Any individual or organization using the Platform.
• We / Us / Our / Organization: Daan Patra Foundation, a non-profit entity.
• Platform / Website: The website and services offered at https://daanpatrafoundation.org/.
• Beneficiary: NGO, trust, society, institution, or individual supported through the Platform.
• Campaign: Any fundraising or donation drive hosted on the Platform.
• Services: Facilitation of donations, campaign promotion, and procurement/disbursal of goods/services for beneficiaries.

2. Scope of Services

Daan Patra Foundation bridges donors and social welfare causes (education, healthcare, disaster relief, animal welfare, etc.). Donations are utilized transparently for the intended purpose; however, if a Campaign’s requirement is fulfilled or circumstances change, funds may be redirected to a similar cause/category at our discretion to ensure timely impact.

3. Eligibility

You confirm that you are at least 18 years of age and competent to contract under Indian law. Foreign donors may contribute only where compliant with applicable Indian laws (including FCRA, if applicable) and payment partner requirements.

4. Platform Role & Campaign Responsibility

We act as a facilitator of charitable giving. While we may perform preliminary verification, Beneficiaries are solely responsible for the accuracy and truthfulness of the information provided in Campaigns and the use of funds. Donors are encouraged to review Campaign details before donating.

5. Donations & Payment Terms

• Payments are processed via secure third-party gateways governed by their terms.
• Recurring donors consent to periodic charges; allocation may occur within the chosen cause/category to meet urgent needs.
• For tax receipts (e.g., 80G), accurate donor details are required at the time of donation.

6. Tax Exemption & Compliance

Eligible donations may qualify for tax benefits under applicable Indian laws (e.g., Section 80G), subject to statutory compliance. Issuance of receipts is based on the details you provide.

7. Crowdfunding Risk, No-Return & Legal Waiver

• Not an Investment: Donations are voluntary and charitable in nature. They do not create any ownership, return, or financial claim.
• No Outcome Guarantee: Outcomes depend on multiple external factors. Lack of expected results does not create a right to damages or refunds.
• Limited Liability: To the maximum extent permitted by law, our total liability for any claim arising from your use of the Platform shall not exceed the total amount you donated to us in the preceding six (6) months.
• No Class Actions: You agree to bring claims only on an individual basis; class, collective, or representative actions are waived.
• Indemnity: You agree to indemnify and hold us harmless from claims arising out of your misuse of the Platform or breach of these Terms.

8. Refunds, Chargebacks & Cancellations

Refunds are limited to exceptional cases (e.g., duplicate transaction, clear gateway error) and processed as per our Refund & Return Policy. Chargebacks initiated without first contacting us may delay resolution. Recurring donations can be cancelled with at least seven (7) days’ notice before the next charge.

9. AML/KYC, Prohibited Uses & Suspension

• We may conduct KYC/AML checks and request information to comply with law.
• Prohibited: illegal/fraudulent activity; misrepresentation; hate, violence, or discriminatory content; activities violating public policy.
• We may suspend or terminate access, or reallocate/withhold funds, where we suspect non-compliance, fraud, or legal risk.

10. Intellectual Property

All content (text, graphics, images, logos, and software) on the Platform is owned by or licensed to Daan Patra Foundation. You may not use, reproduce, or distribute it without prior written permission.

11. Privacy & Data Protection

Your privacy is important to us. Please read our Privacy Policy to understand how we collect, use, and safeguard your data.

12. Third-Party Links & Services

The Platform may contain links to third-party sites. We are not responsible for their content, policies, or practices.

13. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (natural disasters, acts of government, network outages, etc.).

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts at New Delhi, India. Parties shall first attempt good-faith negotiations; failing which, disputes will be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator seated in New Delhi, conducted in English.

15. Changes to Terms

We may modify these Terms at any time. Updates will be posted on this page, and continued use of the Platform constitutes acceptance of the revised Terms.
